Terms of Service

By checking the ‘Yes, I agree to the Terms of Service’ checkbox as part of the MosaicGlobe sign-up process, you agree to the following terms of service on your behalf or on the behalf of the company/organization you represent.

1. Acceptance of Terms
All users of MosaicGlobe services (trial users included) are subject to these terms. MosaicGlobe reserves the right to change this document without notice or acceptance of the user.

2. Services Provided
MosaicGlobe will provide tools which will allow the user to create and maintain a website. Mosaicglobe will host the website and provide email and additional services as they become available. Current and future services will be subject to the Terms of Service. MosaicGlobe will continue to host the user’s website and provide account services as long as the users account is in good standing. Internet access and related hardware requirements must be acquired by the user in order to use the service. MosaicGlobe makes no representation that the operation of the site will be uninterrupted or error-free, and will not be liable for the consequences of any interruptions or errors.

3. Registration
In order use MosaicGlobe’s services, all users must open a valid user account. To do so, the user will be required to provide a credit card, billing information, business name and/or legal name; as well as select a user id and password.

MosaicGlobe reserves the right to suspend or terminate a user’s account(s) when the supplied information is proven or suspected to be untrue, inaccurate, falsified or incomplete.

It is the user's responsibility to protect the security of their user name and password. In the event that your user name and/or password have been compromised, it is the user’s responsibility to change their password within their account and notify MosaicGlobe of any unauthorized access. MosaicGlobe shall not be held liable for any damages resulting from such loss, corruption, unauthorized acquisition or unauthorized use.

4. Billing
MosaicGlobe will bill services to a user’s supplied credit card every month after any trial period has elapsed. Services will be billed in advance for the following month. All payment are non-refundable (there will be no pro-rated or refunded services).

5. Termination
MosaicGlobe reserves the right to terminate an account and delete its content, without prior notice, at its discretion and for any reason including, but not limited to, any violation of the terms outlined in this agreement, at the request of a law enforcement agency, at the user’s request, due to non-payment, due to discontinuation of service offerings and/or unexpected technical issues. In addition, MosaicGlobe may choose to discontinue any and all services provided with or without notice. MosaicGlobe shall not be held liable by the user or any third party for any account terminations and related loss of data. Prepaid terminated accounts will not be refunded.

Accounts may be terminated at any time by the account holder. Termination will be immediate and will result in the irreversible deletion of all account data. MosaicGlobe will not be liable for any loss of content as a result of account termination initiated by the user.

6. Content Ownership and Accountability
All content posted, published and/or uploaded to a MosaicGlobe site is considered to be owned by the account holder. However, MosaicGlobe retains a world-wide, royalty-free, non-exclusive license to reproduce, modify, adapt and publish the content solely for the purpose of promoting MosaicGlobe’s services for as long as a user is a MosaicGlobe customer.

Account holders are entirely responsible for their site’s content. By posting, publishing or uploading content to their website, the site user represents that such user has all rights necessary to post content without violation of any intellectual property or other rights or any laws or regulations. MosaicGlobe does not guarantee the accuracy, integrity or quality of such content.

It is the account holder’s responsibility to abide by all applicable local, state, national and foreign laws, treaties and regulations in connection with the use of MosaicGlobe’s services. The service user agrees that MosaicGlobe will not be held liable in any way for any loss or damage of any kind incurred as a result of the use of any content posted, published, transmitted or otherwise made available via a MosaicGlobe website or services.

The user agrees to indemnify and hold MosaicGlobe, and its affiliates, officers, agents, co-branders or other partners, and employees, harmless from any alleged claim or demand, including reasonable attorney fees, made by any third party due to or arising out of your content, your use of the MosaicGlobe application and Services, your connection to this site or the services, your violation of this Terms of Service or your violation of any rights of another, whether you are a registered user or not. The user is solely responsible for his or her actions when using this Site, the Software or the Services, including, but not limited to, costs incurred for Internet access.

Solicited and unsolicited ideas, concepts or materials shared with MosaicGlobe concerning future products or software enhancements may be used by MosaicGlobe without compensation unless otherwise agreed to in writing via a seperate contract by an authorized MosaicGlobe representative.

7. Prohibited Activities
MosaicGlobe respects that the Internet is a forum for open discussion and the free exchange of information. MosaicGlobe does not take responsibility for any information its users may create nor does it actively review, edit, or censor user sites.

However, when MosaicGlobe users place information on the Internet, they have the same liability as other authors for copyright infringement, defamation, and other harmful speech and because the information they create is delivered via MosaicGlobe’s system and may reach a large number of people, including both other MosaicGlobe users and the internet community at large, a user’s postings to the Internet may affect other users and may harm MosaicGlobe’s goodwill, reputation, and operations. For these reasons, users violate MosaicGlobe’s Terms of Service agreement when they use the MosaicGlobe services to engage in the following prohibited activities:

Spamming
Sending unsolicited bulk and/or commercial messages over the Internet (known as "spamming"). It is not only harmful because of its negative impact on consumer attitudes toward MosaicGlobe, but also because it can overload the MosaicGlobe system and disrupt service to other MosaicGlobe users. When a complaint is received, MosaicGlobe has the discretion to determine from all of the evidence whether the email recipients were from an "opt-in" email list.

Intellectual Property Violations
Engaging in any activity that infringes or misappropriates the intellectual property rights of others, including copyrights, trademarks, service marks, trade secrets, software piracy, and patents held by individuals, corporations, or other entities. Also, engaging in activity that violates privacy, publicity, or other personal rights of others. MosaicGlobe is required by law to remove or block access to customer content upon receipt of a proper notice of copyright infringement. It is also MosaicGlobe’s policy to terminate the privileges of customers who commit repeat violations of copyright laws.

Obscene Speech or Materials
Using MosaicGlobe’s system to advertise, transmit, store, post, display, or otherwise make available child pornography or obscene speech or material. MosaicGlobe is required by law to notify law enforcement agencies when it becomes aware of the presence of child pornography on or being transmitted through MosaicGlobe’s system.

Defamatory or Abusive Language
Using MosaicGlobe’s system as a means to transmit or post defamatory, harassing, abusive, or threatening language or; promoting physical harm or injury against any group or individual, or promoting any act of cruelty to animals.

Forging of Headers
Forging or misrepresenting message headers, whether in whole or in part, to mask the originator of the message.

Illegal or Unauthorized Access to Other Computers or Networks
Accessing illegally or without authorization computers, accounts, or networks belonging to another party, or attempting to penetrate security measures of another individual's account (often known as "hacking"). Also, any activity that might be used as a precursor to an attempted system penetration (i.e. port scan, stealth scan, or other information gathering activity).

Distribution of Internet Viruses, Worms, Trojan Horses, or Other Destructive Activities
Distributing information regarding the creation of and sending Internet viruses, worms, Trojan horses, pinging, flooding, mailbombing, or denial of service attacks. Also, activities that disrupt the use of or interfere with the ability of others to effectively use the network or any connected network, system, service, or equipment.

Facilitating a Violation of this Terms of Service Agreement
Advertising, transmitting, or otherwise making available any software, program, product, or service that is designed to violate this agreement, which includes the facilitation of the means to spam, initiation of pinging, flooding, mailbombing, denial of service attacks, and piracy of software.

Export Control Violations
Exporting encryption software over the Internet or otherwise, to points outside the United States.

Other Illegal Activities
Engaging in activities that are determined to be illegal, including advertising, transmitting, or otherwise making available ponzi schemes, pyramid schemes, fraudulently charging credit cards, and pirating software or; promoting or providing instructional information about illegal activities.

Other Activities
Offering for sale or sell any item, good or service that violates any applicable laws or regulations, or that you do not have full power and authority under all relevant laws and regulations to offer and sell, including all necessary licenses and authorizations.
Any attempt to decompile, reverse engineer, disassemble, modify or hack this site or the MosaicGlobe application.

Using MosaicGlobe Services as a forwarding service to another website, promoting a MosaicGlobe site with inappropriate links, titles, descriptions, or promoting a MosaicGlobe site by posting multiple submissions in public forums that are identical.

Engaging in activities, whether lawful or unlawful, that MosaicGlobe determines to be harmful to its users, operations, reputation, goodwill, or customer relations.
